1. Acceptance of Terms

By accessing and using PIXELIQ ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. In addition, when using these particular services, you shall be subject to any posted guidelines or rules applicable to such services. Any participation in this service will constitute acceptance of this agreement.

2. Description of Service

The Service provides users with AI-powered image analysis tools, including but not limited to content analysis, metadata extraction, color palette generation, and forensic analysis. The Service also allows users to generate creative assets based on this analysis. You agree that the Service is provided "AS-IS" and that PIXELIQ assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings.

3. User Accounts

To access most features of the Service, you must register for a user account. When you register for an account, you may be required to provide us with some information about yourself, such as your email address. You agree that the information you provide to us is accurate and that you will keep it accurate and up-to-date at all times. You are solely responsible for maintaining the confidentiality of your account and password.

4. User-Generated Content

You are solely responsible for any content, including images and data, that you upload, post, or otherwise transmit via the Service ("User Content"). You retain all rights in, and are solely responsible for, the User Content you post to PIXELIQ. However, you grant PIXELIQ a worldwide, non-exclusive, royalty-free license to use, reproduce, process, and display the content solely for the purpose of providing and improving the Service.

5. Prohibited Conduct

You agree not to use the Service to:

• Upload or transmit any material that is illegal, defamatory, harassing, abusive, fraudulent, obscene, or is otherwise objectionable.
• Upload or transmit any material that infringes upon another party's intellectual property rights.
• Use the Service for any illegal purpose, or in violation of any local, state, national, or international law.

6. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. PIXELIQ expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose and non-infringement. The analysis provided by our AI is for informational purposes only and should be verified.

7. Limitation of Liability

You expressly understand and agree that PIXELIQ shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from the use of or inability to use the service.

8. Modification of Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms of Service on this page.
